I've never had a problem with rip-offs of backgrounds I've used, and I've used a lot of backgrounds.
It's mostly the "native" backgrounds that are used that way. A few other examples, but not many. As far as I know, none of that has happened to my games, although in a few occasions someone has independently found the same background.
